1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the DigiCup platform ("Platform"), operated by DigiCup. By registering an account, accessing the Platform, or participating in any tournament, you confirm that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree with any part of these Terms, you must not use the Platform.
2. Eligibility
The Platform is intended exclusively for users who are 18 years of age or older. By creating an account, you represent and warrant that:
- You are at least 18 years of age;
- You have full legal capacity to enter into a binding agreement;
- Your participation complies with all applicable laws in your jurisdiction;
- You have not been previously suspended or permanently banned from the Platform.
DigiCup reserves the right to request proof of age at any time and to immediately terminate any account found to be held by a person under the age of 18.
3. Skill-Based Competition Disclaimer
Important — Skill-Based Platform
DigiCup operates exclusively as an organizer of skill-based eSports competitions. Tournament outcomes are determined entirely by participants' in-game performance, technical skill, strategic decision-making, and competitive execution. No element of chance, randomness, or luck determines competition results. No random number generators (RNGs) or chance-based mechanics are used in determining tournament winners at any stage.
DigiCup is not a gambling service, betting operator, or provider of games of chance. The Platform is classified and operated as an organizer of entertainment and competitive sporting events under the applicable laws of the Republic of Armenia.
4. Non-Gambling Clause
The Platform does not facilitate gambling, betting, wagering, or any game of chance in any form. Specifically:
- No bets are accepted on the Platform;
- No odds are offered on any event or outcome;
- No chance-based prize mechanisms exist on the Platform;
- No random draws or lotteries are conducted;
- Competition results are determined solely by participant skill and in-game performance metrics.
Users must not use the Platform for any purpose related to gambling. Any characterization of Platform activity as gambling, wagering, or chance-based is factually incorrect and expressly rejected by DigiCup.
5. Revenue Model
DigiCup generates revenue exclusively from a service fee constituting a portion of the entry fees paid by tournament participants. This fee compensates DigiCup for the following services:
- Tournament organization, scheduling, and administration;
- Platform infrastructure hosting and maintenance;
- Technical support and dispute resolution services;
- Ongoing platform development and improvement.
DigiCup does not generate revenue from wagering, betting spreads, house edges, or any chance-based mechanism. Our income is strictly service-based and directly tied to the cost of organizing competitive skill-based events.
6. Virtual Coin Policy
6.1 Nature of Virtual Coins
DigiCup virtual coins ("Coins") are internal digital credits used exclusively to facilitate tournament entry fee payments within the Platform. Coins are an internal accounting mechanism and nothing more.
6.2 No Monetary Value
Coins do not constitute currency, legal tender, financial instruments, securities, investment assets, or any form of real-world monetary value. Coins are not redeemable for cash, credit, or any tangible item of value outside the Platform.
6.3 Non-Withdrawable
Coins cannot be withdrawn from the Platform under any circumstances. Coins cannot be:
- Converted to fiat currency;
- Exchanged for cryptocurrency;
- Transferred to any external account, service, or third party;
- Sold or traded between users.
6.4 Acquisition
Coins are acquired by depositing funds through the Platform's payment interface. The Coin exchange rate is set by DigiCup and may be updated with reasonable prior notice.
6.5 Forfeiture
Upon account termination, suspension, or closure, unused Coins may be permanently forfeited. DigiCup has no obligation to compensate for forfeited Coins.
7. Tournament Entry & Participation
- Entry fees for all tournaments are charged in virtual Coins;
- Participants must comply with the specific rules of each individual tournament;
- DigiCup reserves the right to cancel, postpone, or modify any tournament at its sole discretion;
- In the event of tournament cancellation, entry fees paid in Coins will be credited back to the participant''s Platform balance;
- Refunds for Coin purchases are not available except where required by applicable law.
8. Prize Distribution
8.1 Prize Currency
Tournament prizes are awarded in USDT (Tether USD), a stablecoin cryptocurrency. Prize amounts are determined and published prior to the commencement of each tournament.
8.2 Payment Processor
All prize payouts are processed exclusively through Payment Gateway. DigiCup does not process, hold, or transmit cryptocurrency independently.
8.3 No Custodial Relationship
DigiCup does not maintain custodial cryptocurrency wallets, does not store user cryptocurrency funds, and does not act as a financial intermediary at any stage of the prize payout process. All cryptocurrency transactions are executed entirely by Payment Gateway directly to the winner's designated wallet address. DigiCup has no access to user cryptocurrency assets at any point.
8.4 Payout Processing
Prize amounts are transferred to the winner's designated cryptocurrency wallet address through Payment Gateway's infrastructure. DigiCup has no custody over, and no access to, user cryptocurrency assets during or after the payout process.
8.5 Tax Obligations
Winners are solely responsible for reporting and paying any applicable taxes, duties, or levies on prize winnings as required by the laws of their jurisdiction. DigiCup does not provide tax advice.
8.6 Verification
DigiCup may require identity and/or age verification prior to releasing prize payouts. Failure to provide required verification may result in permanent forfeiture of the prize.
9. Anti-Cheating & Fraud Policy
The integrity of competition is fundamental to DigiCup. The following conduct is strictly prohibited:
- Use of unauthorized software, scripts, macros, or exploits;
- Hacking, manipulating, or attempting to alter game data or match results;
- Account sharing or allowing others to compete under your account;
- Creating secondary accounts to gain an unfair competitive advantage;
- Collusion, match-fixing, or coordinating with other participants to manipulate results;
- Any other conduct that undermines fair competition.
DigiCup employs automated and manual detection systems to identify suspicious activity. Users found to be in violation will face permanent account termination, forfeiture of all prize winnings, and may be subject to legal proceedings. DigiCup reserves the right to disqualify any participant at its sole discretion where there is reasonable suspicion of misconduct.
10. Account Suspension & Termination
DigiCup reserves the right to suspend, restrict, or permanently terminate any user account, with or without prior notice, in the following circumstances:
- Breach of any provision of these Terms;
- Engagement in fraudulent, abusive, or illegal activity;
- Providing false, misleading, or inaccurate registration information;
- Age misrepresentation;
- Actions that harm other users, the Platform, or third parties;
- Activity determined by DigiCup to be detrimental to the integrity of competitive events.
Upon termination, your right to access and use the Platform immediately ceases. Unused Coins in a terminated account may be forfeited at DigiCup's discretion. You may appeal account suspensions by contacting us at digicup.tournaments@gmail.com.
11. Intellectual Property
All content on the Platform, including but not limited to logos, trademarks, graphics, text, software, and tournament structures, is the proprietary intellectual property of DigiCup and is protected by applicable intellectual property and copyright laws. You may not reproduce, distribute, publicly display, or create derivative works from any Platform content without express prior written permission from DigiCup.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied;
- DigiCup shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform;
- DigiCup's total aggregate liability for any claim shall not exceed the total entry fees paid by you in the twelve (12) months preceding the event giving rise to the claim;
13. Governing Law
These Terms shall be governed by, and construed in accordance with, the laws of the Republic of Armenia, without regard to its conflict of laws provisions. You irrevocably submit to the exclusive jurisdiction of the competent courts of the Republic of Armenia for the resolution of any dispute arising under these Terms.
14. Dispute Resolution
- Negotiation: The parties shall first attempt to resolve any dispute through good-faith direct negotiation for a period of thirty (30) days from the date one party notifies the other of the dispute;
- Litigation: If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Armenia;
- Class Action Waiver: You waive any right to participate in class-action lawsuits or class-wide arbitration against DigiCup.
15. Modifications to Terms
DigiCup reserves the right to amend, update, or replace these Terms at any time. Material changes will be communicated via a prominent notice on the Platform or by email. Continued use of the Platform following the effective date of any modification constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must discontinue use of the Platform.
